Terms of Use

1. Scope

These Terms govern access to the Flexam Platform (the “Platform”), operated by Flexam Technologies GmbH. The Platform includes Flexam Toolpath Editor and Flexam Slicer. These Terms apply to both products and your shared Flexam account. Access to individual products and features depends on the access granted to your account.

You accept these Terms by continuing past the notice shown when you first enter the Platform. The notice is the same in both products and is shown after you sign in, so there is one acceptance for the Platform rather than one per product. We record which version of these Terms and of the Privacy Policy the notice displayed to you, and when you continued past it. The notice also shows the Share files setting (section 7), switched on; if you continue without switching it off, Share files is recorded as on for your account.

Where these Terms change materially, the notice is shown again and continuing past it accepts the version then displayed. That acceptance is a separate record; it does not alter or replace the earlier one.

2. Early Access and evaluation

The Platform is offered for business, professional, research and evaluation purposes. During Early Access, functionality may change and outputs may contain errors. Users remain responsible for reviewing and validating outputs before any manufacturing or production use.

The Early Access programme is provided free of charge.

Outputs may be used in production once you have reviewed and validated them. Flexam does not certify outputs as production-ready, and validation remains yours. The Platform is not offered to consumers within the meaning of Sec. 1 KSchG.

3. Account registration

To access the Platform, users create an account using supported authentication methods. You are responsible for maintaining the confidentiality of your account and for all activities performed under it. Flexam may suspend or terminate accounts in case of misuse or violation of these Terms.

4. Free access, and existing paid access

The Early Access access described in this offer is provided free of charge. Any separate paid offer, access period or fee must be presented and accepted separately before it applies.

Participation in Early Access creates no payment obligation.

Flexam may offer paid time-limited access to the Platform. Where such an offer is presented and accepted separately, each purchase grants access for thirty (30) consecutive days from the date of payment, access expires automatically at the end of that period, and no automatic renewal applies. Fees are displayed before purchase and may be subject to applicable taxes. By purchasing access, the user expressly requests immediate provision of the digital service and acknowledges the loss of any statutory withdrawal right, insofar as legally permissible.

Those provisions apply only to a separately purchased access period. They do not apply to free Early Access, and nothing here grants or removes rights under an access period already purchased. Nothing here promises that free access continues indefinitely.

5. Use of the Platform

Users may upload technical files such as 3D models, evaluate Platform functionality, and generate software outputs. Users must not use the Platform for unlawful purposes, upload infringing or malicious content, or attempt to reverse engineer, disrupt, or overload it.

6. Uploaded content and ownership

Users retain full ownership of all uploaded files and content. Flexam does not claim ownership over customer data.

By uploading or otherwise submitting content, users grant Flexam a non-exclusive, limited, royalty-free licence to process and analyse the content, provide requested outputs, and store the content as needed to operate the Platform for them, for example so that projects and jobs remain available. This licence is strictly limited to operating the Platform. Keeping copies of content for debugging, quality testing and product improvement is permitted only under the optional Share files setting described in section 7. Other diagnostic uses follow the permitted scope and the user controls described in section 7 and in the Privacy Policy. No further licence is granted for third-party model training or unrelated reuse.

During Early Access, authorised Flexam team members may review the files you upload and your associated workflow to understand difficulties, troubleshoot issues and improve your experience with the product. Your files remain yours and are not used for other customers’ projects or AI training.

Users must have the necessary rights to submit company material. An individual user’s privacy choice does not by itself establish those rights.

7. Diagnostics and controls

Flexam uses feedback and permitted product diagnostics to understand real workflows, identify issues and improve the Platform. Categories of data, purposes, recipients, applicable legal bases, retention and user controls are described in the Privacy Policy. Optional product analytics, AI diagnostics and session replay can be disabled in Privacy settings without ending access to the Platform.

Share files. Share files is a separate setting in Privacy settings, and it is also shown on the Early Access notice. It is on by default: the notice shows it switched on, and you can switch it off there before you continue or at any time later in Privacy settings. If you had already turned Share files on or off before this version of the Terms, that choice is kept. It is not one of the three controls above. While it is on, you allow Flexam to retain copies of your uploaded models, input and output code and related diagnostics for up to 30 days to reproduce errors, test fixes and improve the product. Copying applies only to content submitted while Share files is recorded as on for your account, never to earlier content. At present, copies are made only from Flexam Toolpath Editor sessions; files uploaded to Flexam Slicer are not copied under this setting.

For that purpose only, and while Share files is on, you grant Flexam a non-exclusive, royalty-free licence, which ends when you turn Share files off, to store, reproduce and analyse those copies for debugging, quality testing and product improvement. Flexam does not publish or sell the copies, does not use them to train third-party AI models, and does not use them contrary to confidentiality obligations that apply to them. Training any AI model on them is not covered by this permission. Access is limited to authorised Flexam personnel and to service providers contracted to store or process the copies for Flexam. You keep ownership of your content.

Only share materials you are authorised to provide for these purposes. Your permission does not override the rights of your employer, your customers or anyone else in the material, and does not by itself establish that you hold those rights.

You can turn Share files off at any time without losing access. Flexam then stops making new copies immediately and starts deleting the copies already made under this setting; in any case, copies are automatically deleted within 30 days. Content that Flexam stores to run your projects is separate from these copies and is not affected by this setting. How deletion is carried out, and the legal basis for any personal data in the copies, are described in the Privacy Policy.

8. Software outputs and disclaimer

The Platform provides experimental and evaluative outputs only. Flexam does not guarantee that outputs are error-free, or that results are suitable for production or manufacturing without validation. Users remain fully responsible for reviewing and validating all outputs.

9. Intellectual property

All rights to the Platform, software, algorithms, interfaces and documentation remain the exclusive property of Flexam Technologies GmbH. No rights are transferred to users except those explicitly stated.

10. Availability and changes

The Platform is provided on an “as is” and “as available” basis. Flexam may modify or discontinue features, update the Platform, or suspend access for maintenance or technical reasons.

11. Termination and exit

Users may stop using the Platform at any time. Disabling optional analytics, AI diagnostics, session replay or Share files does not terminate their account or remove their existing product access. Data handling and rights following withdrawal, objection or account closure are described in the Privacy Policy.

Flexam may suspend or terminate access if these Terms are violated, misuse is detected, or it is required by law.

12. Limitation of liability

To the maximum extent permitted by law, Flexam is not liable for indirect or consequential damages, does not guarantee uninterrupted availability, and limits liability to intent and gross negligence. Mandatory liability under Austrian and EU law remains unaffected.

13. Privacy and data protection

Personal data is processed in accordance with the Privacy Policy, which forms an integral part of these Terms.

14. Changes to these Terms

Flexam may update these Terms from time to time. Material changes will be communicated via the Platform or by email.

15. Governing law

These Terms are governed by the laws of Austria, excluding conflict-of-law rules. Place of jurisdiction: Vienna, Austria, where legally permissible.
